Terms of Service

1. Eligibility (18+)

MagikBox AI is an adult service and is strictly for adults. You confirm that you are at least 18 years old (or the age of majority where you live, if higher), that you have the legal capacity to enter this agreement, and that adult content is lawful where you access it.

You are responsible for keeping your account credentials secure and for all activity under your account.

2. The Service

MagikBox AI provides AI tools that generate images and video from your prompts and uploads. Outputs are produced by machine-learning models and are synthetic. We do not pre-screen every output, we do not guarantee any particular result, and the service is provided on an "as is" and "as available" basis.

We may add, change, suspend, or remove models, features, or limits at any time.

4. Tokens and payments (cryptocurrency)

The service runs on tokens, which are a prepaid, internal credit used to access generation features. Tokens are purchased with cryptocurrency. Tokens have no cash value, are not money, are not securities, are not transferable between accounts, and cannot be redeemed, exchanged, or withdrawn for cash or cryptocurrency.

All purchases are final. Because cryptocurrency payments are irreversible, all token purchases are non-refundable and there are no chargebacks, except where a refund is required by applicable law. You are responsible for any network fees, exchange-rate differences, and any taxes that apply to your purchase. You must use only funds and wallets that you lawfully own and control.

If a generation fails for a technical reason on our side, we may, at our discretion, restore the tokens for that generation. Unused tokens may expire or be forfeited if your account is closed or terminated for a violation of these Terms.

5. Intellectual property

As between you and us, and to the extent permitted by law, you own the outputs you generate from your own inputs, and you are responsible for how you use them. AI outputs may not be eligible for copyright protection in some jurisdictions, and similar prompts can produce similar results for other users, so we make no promise of exclusivity.

The MagikBox AI name, brand, site, and software are owned by us and are protected by intellectual-property laws. You may not copy, scrape, resell, reverse engineer, or build a competing service from our platform.

You grant us a limited license to host, process, and display your inputs and outputs only as needed to operate, secure, and improve the service and to enforce these Terms and the law.

6. Third-party technology

The service relies on third-party computing and model providers to produce outputs. Your use of the service is also subject to the lawful-use expectations of those providers. We are not responsible for the acts or omissions of third parties, and their availability is outside our control.

7. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that outputs will meet your expectations or be free of objectionable content.

8. Limitation of liability

To the fullest extent permitted by law, MagikBox AI and its operators, owners, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or cryptocurrency, arising out of or relating to the service or your content, even if advised of the possibility.

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 90 days before the event giving rise to the claim, or 100 US dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless MagikBox AI and its operators, owners, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your inputs or outputs, your use of the service, your violation of these Terms or the Acceptable Use Policy, or your violation of any law or any rights of any person.

10. Dispute resolution and arbitration

Please contact us first so we can try to resolve any issue informally. If we cannot, you and we agree that any dispute relating to these Terms or the service will be resolved by binding individual arbitration on an individual basis, and not in a court, except that either party may bring an individual claim in small-claims court.

You and we waive any right to a jury trial and any right to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms; opting out does not affect the other Terms.

11. Termination

We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms or the Acceptable Use Policy or any suspected unlawful activity. You may stop using the service at any time. Sections that by their nature should survive termination will survive, including content responsibility, payment finality, disclaimers, limitation of liability, indemnification, and dispute resolution.

12. Governing law and changes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules, except that the arbitration agreement is governed by the Federal Arbitration Act where it applies. We may update these Terms, and the "last updated" date shows the current version. If a change is material, we will take reasonable steps to notify you, and continued use after a change means you accept it.

13. General

These Terms, together with the Acceptable Use Policy and Privacy Policy, are the entire agreement between you and us about the service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them. We are not liable for delays or failures caused by events beyond our reasonable control.
